Terms and Conditions (Consent Required) [Terms and Conditions for Online Members of Vely B Clinic] The purpose of these terms and conditions is to outline the terms of use, procedures, and other necessary matters for the services provided by Vely B Clinic (hereinafter referred to as "the Clinic"), in accordance with the Telecommunications Business Act and its Enforcement Decree. Article 1 (Purposes, etc.) ① The Terms and Conditions of the Clinic (http://velyb.kr) (hereinafter referred to as "these Terms") are intended to define the rights, obligations, and responsibilities of both the members and the Clinic in relation to the use of the online services provided by the Clinic (hereinafter referred to as "the Services"). ② If an individual wanting to become a member completes the required procedures set by the Clinic and clicks the "Register" button, it is deemed that they agree to these Terms. Matters not specified in these Terms regarding the rights, obligations, and responsibilities of the members and the Clinic shall be governed by the Telecommunications Business Act and other relevant laws and applicable customary practices of the Republic of Korea. Article 2 (Definition of Member) A "Member" refers to an individual who accesses the Clinic, registers as an online member of the Clinic in accordance with these Terms, and receives the services provided by the Clinic. Article 3 (Membership Registration) ① An individual who wishes to become a member shall apply for membership by filling out the member information in the registration form provided by the Clinic and clicking the "Register" button. ② The Clinic will register the applicant in subsection 1 as a member unless the applicant falls under any of the following categories: 1. If the applicant has previously lost their membership in accordance with Article 6, Paragraph 3 of these Terms. However, an exception is made if more than three years have passed since the loss of membership under Article 6, Paragraph 3, and the applicant has obtained approval for re-registration from the Clinic. 2. If there is any false information, omission, or error in the registration details. 3. If the Clinic determines that registering the applicant as a member may cause significant technical difficulties. ① The membership contract is considered to be established at the time when the Clinic's acceptance reaches the applicant. ② If there are any changes to the information provided by the member under Paragraph 1, the member must immediately update and correct the information. Article 4 (Providing and Altering of Services) ① The Clinic provides the following services to its members: 1. Newsletter service from the Clinic; 2. Online consultation and appointment services; 3. Sections and content services for online members of the Clinic; and 4. Various other services provided in partnership with third-party companies. ② The Clinic may alter the content of the services listed in Paragraph 1. In such cases, the Clinic will notify members in accordance with contents of services altered and the application date of new services in the manner specified in Article 7, Paragraph 2. Article 5 (Suspension of Services) ① The Clinic may temporarily suspend the provision of services in the event of maintenance, inspection, replacement, or failure of information and communication facilities such as computers, or in the case of communication disruptions. Additionally, the Clinic may completely discontinue the currently provided services for reasons deemed appropriate, including replacement with new services. ② In the case of service suspension as described in Paragraph 1, the Clinic will notify members using the manners specified in Article 7, Paragraph 2, unless service suspension occurs due to reasons beyond the Clinic's control (such as disk failures without deliberate or negligent actions of system administrators, system downtime, etc.) and prior notification may not be possible. Article 6 (Membership Withdrawal, Disqualification, etc.) ① A member may request the cancellation of their membership registration (withdrawal) from the Clinic at any time, and the Clinic will proceed with the cancellation process immediately upon receiving such a request. ② The Clinic may restrict, suspend, or terminate a member's membership in an appropriate manner if the member falls under any of the following categories: 1. Providing false information during the application process; 2. Interfering with others’ use of the Clinic's website or threatening order of electronic transactions by stealing information; or 3. Engaging in actions that violate laws or these Terms, or are contrary to public order and morals while using the Clinic. ③ If the Clinic decides to terminate a member's membership, the member's registration will be canceled. In this case, the Clinic will notify the member prior to cancellation and provide an opportunity for the member to provide explanation. Article 7 (Notification to Members) ① When the Clinic notifies a specific member, it may do so using the email address registered with the Clinic. ② When the Clinic notifies a large number of unspecified members, it may substitute individual notifications by posting the notice on the Clinic's bulletin board for more than one week. Article 8 (Members’ Privacy Information Protection) The Clinic strives to protect the privacy information of its members, including registration details, in accordance with applicable laws and regulations. The protection of privacy information is governed by the relevant laws and the "Privacy Policy" established by the Clinic. Article 9 (Obligations of the Clinic) ① The Clinic does not engage in any activities that are prohibited by laws or these Terms, or that are contrary to public order and morals, and it strives to provide services continuously and stably in accordance with these Terms. ② The Clinic will establish a security system to protect members' privacy information (including credit information) to ensure safe use of online services. ③ The Clinic will not send unsolicited promotional emails for commercial purposes to members. Article 10 (Members’ Obligations Concerning ID and Password) ① Except in cases where the Clinic shall be responsible under relevant laws and the "Privacy Policy," each member is responsible for managing their own ID and password. ② Members must not allow their ID and password to be used by third parties. ③ If a member becomes aware that their ID and password have been stolen or are being used by a third party, they must immediately notify the Clinic and follow the Clinic's instructions if provided. Article 11 (Obligations of Members) ① Members must not engage in any of the following activities: 1. Registering false information during the application for membership or when making changes; 2. Altering information posted by the Clinic: 3. Infringing on the personal rights or intellectual property rights of the Clinic or other third parties, or interfering with their business; 4. Misappropriating another member's ID; 5. Sending junk mails, spam mails, chain letters, emails soliciting participation in pyramid schemes, or other messages containing obscene or violent contents, or publicly disclosing or posting information that is contrary to public order and morals; 6. Transmitting or posting information that is prohibited from being transmitted or posted by relevant laws (such as computer programs); 7. Impersonating or pretending to be an employee of the Clinic or an administrator of the Clinic's online services, or posting or sending emails using another person's name; 8. Posting or sending via email materials containing software viruses or other computer codes, files, or programs designed to interfere with or destroy the normal operation of computer software, hardware, or telecommunications equipment; 9. Harassing other members, such as stalking; 10. Collecting, storing, or publicly disclosing privacy information about other members without consent; 11. Using the Clinic's services for commercial purposes by posting advertisements or promotions or sending spam mails to a large number of unspecified recipients; or 12. Violating the terms and other regulations regarding the use of services provided by the Clinic. ② If a member engages in any of the activities listed in Paragraph 1, the Clinic may restrict, suspend, or terminate the member's membership in an appropriate manner in accordance with Article 6, Paragraphs 2 and 3 of these Terms. ③ Members are responsible for compensating the Clinic or other members for any damages incurred as a result of their own actions. Article 12 (Deleting Publicly Disclosed Postings) If the contents of a member's publicly disclosed posting falls under any of the following categories, the Clinic may delete the posting without prior notice to the member and may restrict, suspend, or terminate the member's membership: 1. Any content that defames or slanders another member or a third party, damaging their reputation; 2. Any content that disseminates information, sentences, or graphics that violate public order and morals; 3. Any content that is deemed to be related to criminal activity; 4. Any content that infringes on the copyright or other rights of another member or a third party; 5. Any content that is predominantly promotional or commercial in nature; and 6. Any content that is deemed to violate other relevant laws. Article 13 (Vesting of Copyrights and Restriction of Use) ① Copyright and other intellectual property rights for works created by the Clinic shall be vested to the Clinic. ② Members shall not use the information obtained through the use of the Clinic for commercial purposes, nor allow third parties to use it, without the prior consent of the Clinic, including reproduction, transmission, publication, distribution, broadcasting, or any other methods. Article 14 (Regulations for Consultations) ① The contents of consultations conducted through the service may be used for the following purposes after privacy information has been removed: 1) Academic activities; 2) Medical activities; 3) Healthcare services; 4) Publications such as printed materials and CD-ROMs; 5) Parts of service contents such as FAQs and referrals. ② The consultation service may not be provided in whole or in part in the following cases: 1) If the same consultation request is submitted repeatedly; 2) If the request for consultation uses expressions that are contrary to common sense or includes profanity; 3) If the request for consultation demands a diagnosis; 4) If the request for consultation pertains to treatment costs, examination fees, medication prices, or the effects of medications; and 5) If the consultation is requested for the purpose of obtaining information to harm others. Article 15 (Revision of Terms and Conditions) ① The Clinic may revise these Terms within the scope of compliance with relevant laws, including the Act on the Regulation of Terms and Conditions, the Basic Act on Electronic Transactions, the Electronic Signature Act, and the Act on Promotion of Information and Communications Network Utilization. ② If the Clinic revises these Terms, it will specify the effective date and reasons for the revision, and will notify members by posting the information alongside the current Terms on the initial screen at least seven days prior to the effective date. ③ When the Clinic revises these Terms, the revised Terms shall apply to members who registered before the revision, provided that the amended contents do not violate relevant laws. ④ Members who disagree with the revised Terms may withdraw their membership in accordance with Article 6, Paragraph 1. Article 16 (Competent Jurisdiction) Any lawsuits arising from disputes regarding the use of services between the Clinic and its members shall be filed with a court of competent jurisdiction in the Republic of Korea in accordance with the Civil Procedure Act. Addendum These Terms shall be in effect from October 25, 2018, until new Terms are issued.
